1. Introduction & Acceptance of Terms

This legally binding Terms of Service agreement ("Agreement") governs your access to and use of The Play Kit website and the digital products provided herein. By accessing this website, initiating a transaction, or downloading any digital assets, you ("User", "Licensee", or "Customer") unequivocally agree to be bound by the terms and conditions set forth below. If you do not agree to these terms in their entirety, you are strictly prohibited from utilizing this site or purchasing our products.

2. Digital Product License & Anti-Piracy Policy

Upon the successful payment of the Twenty-Seven Dollar ($27.00 USD) purchase price, The Play Kit grants you a limited, non-exclusive, non-transferable, and fully revocable license to download, access, and print the digital storybooks and coloring books solely for personal, non-commercial home use.

STRICT PROHIBITIONS: Under no circumstances does this license grant you the right to exploit the intellectual property for financial gain. You are expressly prohibited from:

Reselling, sublicensing, or unlawfully redistributing the digital files, either entirely or in part.
Modifying, reverse-engineering, or creating derivative works based on our illustrations or copy.
Uploading the files to third-party marketplaces, print-on-demand services, or publishing platforms (including, but not limited to, Etsy, Amazon KDP, Redbubble, or Apple Books).
Sharing unwatermarked digital files or direct download links on public forums, social media, or peer-to-peer networks.

Any violation of this license will result in immediate termination of your access rights without refund, and The Play Kit reserves the right to pursue maximal statutory damages for copyright infringement under applicable international intellectual property laws.

3. Merchant of Record & Liability Delegation

The Play Kit utilizes Lemon Squeezy as our authorized online reseller and Merchant of Record (MoR). By making a purchase, you acknowledge that Lemon Squeezy is the entity processing your payment, calculating and remitting applicable local consumption taxes (such as VAT or Sales Tax), and maintaining the secure payment gateway.

We disclaim all liability for any payment gateway failures, unauthorized data breaches originating from the MoR's infrastructure, or billing errors. Any financial data submitted during checkout is governed strictly by Lemon Squeezy's Terms of Service and Privacy Policy. We do not store or process your credit card information on our servers.

4. Digital Goods Final Sale Policy & Alternative Resolution

Due to the instant accessibility and digital nature of the products delivered by The Play Kit, all purchase transactions are final, non-cancelable, and strictly non-refundable. Once the digital file download links have been generated or transmitted via email, no option for asset returns can exist.

In lieu of traditional cash refunds, we fulfill our 14-Day "Play-Success Promise." If our activity materials do not successfully drive child engagement within 14 calendar days from the date of purchase, the Customer may contact our support channel. We pledge to work with you 1-on-1 via technical and educational consultation to adapt, alter, or customize our materials to suit your child’s specific educational requirements.

ANTI-CHARGEBACK FRAUD CLAUSE: We maintain a zero-tolerance operational standard against illegal chargebacks and payment disputes (friendly fraud). Filing an unauthorized payment dispute with your credit card issuer, bank, or payment vendor constitutes an explicit material breach of this Agreement. In the event of a dispute, we will aggressively submit complete evidence packages to the acquiring banks, Merchant of Record, and financial institutions. This automated and manual tracking includes your unique customer IP address, exact secure download logs, file access timestamps, email delivery receipts, and verification of agreed checkout terms to preserve transaction integrity.

5. Disclaimer of Warranties

The digital products provided by The Play Kit are delivered on an "AS-IS" and "AS-AVAILABLE" basis. To the maximum extent permitted by applicable law, we expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the files will be compatible with specific hardware, printers, or software systems. We do not warrant that the use of the products will meet your specific requirements or expectations.

6. Limitation of Liability

To the maximum extent permitted by law, in no event shall The Play Kit, its founders, affiliates, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use or inability to use the digital products.

Under no circumstances shall our aggregate financial liability to you for any claims arising from this Agreement exceed the original purchase price paid by you for the digital product bundle (i.e., $27.00 USD).

7. Dispute Resolution, Arbitration & Class Action Waiver

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to this Agreement, or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding individual arbitration rather than in a court of general jurisdiction.

Class Action Waiver: You and The Play Kit agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. By entering into this Agreement, you expressly waive your right to participate in a class action lawsuit or class-wide arbitration against The Play Kit.

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the business operates, without giving effect to any principles of conflicts of law.
